School Service Agreement

1. Parties

This School Service Agreement ("Agreement") is between Mcqplex Tech Pvt. Ltd., operating as MCQplex ("Platform"), registered under Nepal's Companies Act 2063 and the subscribing school institution ("School").

2. Subscription and Pricing

  • Schools subscribe to a tiered plan based on number of active student seats.
  • Pricing is confirmed at the time of enrollment and is subject to annual review with 30-day advance notice.
  • Payment is due at the start of each billing cycle. Invoices unpaid after 14 days result in read-only access.

3. What the School Gets

  • Access to the School Admin Portal for managing student enrollments.
  • Class-level and student-level performance analytics.
  • Assigned student seats up to the subscribed limit.
  • Email support with a 2-business-day response target.

4. School Responsibilities

  • Provide accurate student data (names, grade, enrollment status).
  • Do not share admin credentials with students or unauthorized staff.
  • Notify [email protected] within 48 hours if admin credentials are compromised.
  • Ensure students are informed that their exam data is recorded on this platform.

5. Data Ownership

Exam results and performance data are owned jointly by MCQplex and the School. The School may export its student data at any time via the admin portal. MCQplex retains the right to use anonymized, aggregated data for platform improvement and benchmarking.

6. Termination

Either party may terminate this agreement with 30 days' written notice to [email protected]. Upon termination:

  • The School's data export will be provided within 14 days in CSV format.
  • Student accounts linked to the school will be deactivated.
  • No partial-month refunds are issued unless termination is due to a platform breach.

7. Service Level Agreement (SLA)

MCQplex targets 99% monthly uptime for all core features (exam engine, result display, analytics). If uptime falls below 99% in a calendar month due to platform fault, the School will receive a credit equal to the pro-rated value of the downtime applied to the following month's invoice. Scheduled maintenance windows communicated 48 hours in advance are excluded from SLA calculations.

8. Liability

MCQplex is not liable for damages arising from School misuse of the platform, inaccurate data entered by the School, or connectivity issues outside the platform's infrastructure.

9. Governing Law

This agreement is governed by the laws of Nepal. Mcqplex Tech Pvt. Ltd. is incorporated and operates under Nepal's Companies Act 2063. Disputes shall first be attempted to be resolved through written negotiation; unresolved disputes proceed to arbitration in Kathmandu.
